PROBATION GRANTED

MACHINE TAKEN AWAY I SEEKING MONEY BACK Probation was granted yesterday by Mr. Justice Fair to Percy Cariyon, motor-driver, aged 32 (Mr. Aekins), who had pleaded guilty to the theft of a "fruit machine" valued at £6O and £9 9s Od from it. Mr. Aekins said that Cariyon had been unable to follow his occupation on account of rheumatoid arthritis and had been on sustenance. The machine he took was really illegal in this country. He had lost some money on it and took this stupid expedient of taking it away to get even with it. Ho extracted about £9 from it, of which about £4 10s had been recovered. His Honor said the depositions seemed to support the statement that the prisoner did not intend to steal the machine, but was going to return it. Actually the charge against him wap of stealing the money. He was prepared to give him the benefit of his previous good record and release him on probation for two years, on condition that he take out prohibition orders against himself, make restitution and pay the costs of the prosecution.
