CLAIM FOR COMPENSATION I FALL AGAINST QUARTZ TRUCK « . ... A claim for compensation for injuries suffered during the course of his employment bv the Martha Gold Mining Company (Waihi), Limited, at Waihi, 011 February 4, 1938, -was brought by .Tames Thomas Dowso, a miner, in the Arbitration Court yesterday. Mr. Sullivan represented the plaintiff and Mr. Hore appeared for the defendant company.

in his statement of claim, plaintiff said he had been backing a full truck of quartz when both his feet slipped and he fell backward, striking the lower part of his back on a buffer and sustaining injuries to the lower portion of his spine. In consequence, plaintiff contended, he was, and continued to be, disabled from earning wages from that date.

Plaintiff said lio bad been paid compensation at the rate of £3 18s 7d a week from February 4 to July 15. He claimed payment at the same rate from July 15 up to the present, a lump sum, £1 as medical expenses, costs, and such other relief as might be deemed just. The defendant company denied the extent of incapacity claimed, and said plaintiff had been offered compensation up to and including August 4, 1938. and for 13 weeks thereafter, but had refused the offer. After hearing medical evidence the Court reserved its decision.
