James Harry Whiting, shunter, of Morrinsville, who was in - charge of the shunting operations, stated that two trucks had been "kicked"into the siding with the deceased riding on the brake between the trucks. He had given the signal to kick to the driver of the locomotive and had lost sight of the trucks when they entered the locomotive slied. •He happened to look back later and saw the trucks, but saw no-sign of the deceased, whom he surmised had released the brake and was therefore out of sight. He had warned deceased to bo careful as both brakes were on the off side, which did not give much clearance passing two jnetal, hoppers- fcesida the line.
