NEW TRIAL REFUSED WIDOW AWARDED £ISOO ' / MOVE BY RAILWAY DEPARTMENT [from our ows correspondent] HAMILTON, Friday Legal argument was heard by Mr. Justice Reed in the Supreme Court at Hamilton in the case in which Mr. H. T. Gillies, on behalf of the Railway Department, moved for a new trial in connection with the claim of Mrs. Jennie McAlister for damages arising out of the death of her husband, William Graham McAlister, in a sandpit accident at Ngaruawahia in February last. Mr. Gillies contended that the jury's verdict in suppliant's favour was against the weight of evidence. ' Mr; A. L. Tompkins opposed the application on suppliant's behalf.
His Honor held that after reviewing all the circumstances of the case the verdict was not one that the jury could not reasonably have found. The motion for a new trial, as well as one for a non-suit preferred by Mr. Gillies, was dismissed. Judgment was entered for suppliant for the £ISOO awarded by the jury, together with costs.
