CONTRACT RESCINDED
EXECUTOR'S APPLICATION t An action by an executor to have an agreement'! formally rescinded by the Court was brought before Mr. Justice Ostler in the Supreme Court yesterday. The plaintiff was William McLennan, of Kohimarama, surfaceman, as executor of the estate of the late Frederick Robin Col ledge, under whose will the defendant, Mrs] Mary Henderson, of St. Heliers, was left furniture and a section. Mr. Jordan, for plaintiff, said that McLennan proposed to sell the section to pay certain expenses and Mrs. Henderson agreed to buy it for £34. An agreement to this effect was drawn up by solicitors, but Mrs.. Henderson had repeatedly declined to perform her part of the contract. ,i;.. After plaintiff had been heard. His Honor ordered the rescission of the contract with costs and expenses against defendant.
