PENALTY ON DRIVER

REQUEST FOR REVIEW RECENT SPEEDING CASE The effect of a penalty imposed on a speeding motorist a fortnight ago was referred to by Mr. T. N. Holmden in the Papakura Magistrate's Court yesterday. Mr. Holinden applied for a rehearing of the caso in which William Walker, salesman, of Hamilton, was fined £5 and had had his licence suspended for six months for driving his car at speeds from 55 to 68 miles an hour when coming into Otahuhu on December 16. Mr. Holmden said that when the caso was called, at the previous sitting of the Court, counsel entered a pica of guilty oil behalf of defendant, who.was not present. Defendant still admitted speeding, but wished to have the penalty reviewed, as it comprised, in effect, a fine of: £BO. Defendant's agreement with his employers specified that he must use a car in his work. He had now to pay a driver £3 a week. Over six months this would amount to about £75.

The magistrate, Mr. F. H. Levien, said he would look into the question whether a rehearing could be granted a defendant who pleaded guilty. He adjourned the application until March 1.
