SPEEDING CYCLIST
PEDESTRIAN KNOCKED DOWN FINE ON NEGLIGENCE CHARGE An unusual case was heard at the Otahuhu Magistrate's Court yesterday, when Cecil Evelyn Kennerley was charged with riding his bicycle in a negligent manner. Defendant pleaded guilty. / Sergeant J. Cahill said that two pedestrians,. a. rtan and woman, were walking southward on the bitumen edge of the concrete on the Great South Road at Pa pa toe toe, on the night of July 30 and defendant crashed into themfrom behind. It was bright moonlight. The man was knocked down and seriously injured, and did not recover consciousness until the next morning. Defendant's speed on * his bicycle was estimated at between 20 and 25 miles an hour. . * . •.
While admitting the facts.were correct, defendant said he thought his speed had not exceeded 10 miles an hour. ...
The magistrate, Mr. W. R. McKean, said it was the cuty of all users of the road to exercise care. Defendant had been guilty of negligence. He was convicted >nd a'fine of £l and 12s costs imposed.
