MOTORIST FINED

SPEED AT INTERSECTION COMMENT BY MAGISTRATE "This looks like a full-dress rehearsal and I do not want to give either side a lift forward in any civil action," remarked Mr. F. K. Hunt, S.M., in the Magistrate's Court at Otahuhu yesterday, when Sidney John Climo (Mr. Burt) was charged with dangerous driving, following a collision between two motor-cars at Papatoetoe on April 4. At the magistrate's suggestion, after evidence for the prosecution had been heard, the charge was amended to one of failing to observe the regulation speed when passing an intersection. James Queen said he was driving from East Tamaki to Papatoetoe and when making a right-hand turn into Kolmar Road from the Great South Road defendant's car, which was proceeding northward, collided with his vehicle. He could not estimate defendant's speed, but thought it was "terrific." x

A statement given by defendant estimated his speed at about 25 miles an hour. Mr. Hunt: On that, I think it would be wise for the information to be amended. The speed limit at intersections is 15 miles an hour.

Defendant pleaded guilty to the amended charge, and a fine of £1 and costs • was imposed. ".That will allow you both to start from scratch in the civil action which I can see pending," added the magistrate.
