SMOKING IN DANCE HALL
FAILURE OF PROSECUTION [FROM OUR OWN CORRESPONDENT] PUKEKOHE, Wednesday , A charge of smoking in tho Orange Hall, Pukekohe, during the progress of a dance on August 17, was brought by the Pukekohe Borough Council against George Fowler, of Onowhero (Mr. Arrowsmith), in tho Pukekohe Magistrate's Court to-dny. The presiding justices were Messrs. S. P. Day and D. McC. Armstrong.
Tho superintendent of the fire brigade, N. L. Brown, stated that a fire brigade dance was being conducted. Early in tho evening he noticed defendant smoking and warned him that it was contrary to tho borough by-laws. Tho .cigarette was extinguished. Toward the end of the evening ho again saw defendant smoking, but before ho could reach him defendant went into the cloakroom..Ho donned his coat and returned to the hall still smoking.
To counsel witness added that defendant was near tho door of tho hall when smoking. Others were smoking in tho dressing room. Mr. Day: Was defendaut the only one smoking? Witness: Ho was tho only one who smoked after being warned. There were others smoking in the dressing room.
Mr. Day: Your by-laws say no smoking in any part of the building.
Mr. Brown: I allow tho concession of smoking in the dressing rooms. Mr. Day: The case is dismissed.
