PROSPECTING FOR GOLD

AREA AT HUKERENUI V WARDEN GRANTS LICENCE [FROM OTTR OWN CORRESPONDENT] WHAHGABBI. Friday Sf Reserved decision has been given by warden, Mr. G. N. Morris, on an for a gold prospecting licence ; i&ver an area of about 12 acres at Huke3fenui. The application was made by nEdith Mary Bayliss and "William Robert •JJayliss (Messrs. Johnson and Baslev), Ifrho had been holding the land under Tat lease. The owners, R. C. M. Harig.•ton, J. E. Wool ley and G. E. "Woolley g|Mr. Steadman) objected to the application, the main objection being that -the land was. not open for mining under jthe Mining Act. At the hearing the warden held that - Sfche objection must fail. Further obijfections were made that the applicants Jbad failed to sorve proper notices. Delusion on these points was reserved, as £fras also the question of compensation jjfor any damage to the surface of the >sand. **■ In giving his decision regarding notices the warden said it was obvious these provisions of the Act were intended to prevent friction between an ' .applicant for privilege and an occupier, Srhich in this case was same person. No ■ 'j&ne had been misled and no damage •Jiad been done. The-warden intimated *Je would grant the application. m On the question of compensation the • -garden held that the owners were not Entitled to security for any compensation that might arise; that as the Owners had not acquired the right of freehold until after the constitution of f tthe Puhipuhi mining district they wore "jfabt entitled to compensation. V At this stage Mr. Basley stated that $n view of the need for preserving harmony between the parties the applicants would agree to the licence being ,"issued with a condition that the licensee Should not dig trenches on the land Without the consent of the warden. - 3- The application was granted with the -4dditional condition. Costs totalling £6 allowed.
