BUILDING DISPUTE
COURT DISMISSES APPEAL i fho written judgment of Mr. Justice Reecl in an appeal against a magistrate's decision in a building contract dispute was given in the Supremo Court yesterday. The appellant was Mrs. Lily Fisher, of Kohimarama (Mr. Gould), and the respondent Christopher Daniel Sellars, of Auckland, builder (Mr. Turner), who had built a house for Mrs. Fisher at Kohimarama last year. The original contract price was £9OO hut Sellars made a claim for a furthor £ll6 for extras and was allowed £lO3 in the Magistrate's Court. Mrs. Fisher appealed against - this decision on the ground that the extra items had not been agreed to. His Honor said he saw no reason to disagree with the findings of the magistrate and dismissed the appeal, with costs £2O, and witnesses' expenses and disbursements
