SEQUEL TO FATALITY
CASE AGAINST DRIVER ALLEGATION OF NEGLIGENCE [rsoii OUR owx coerkspondknt] MOEBINSYILLE, Saturday In the 3lagistrate's Court at Morricisrille, Henry Gordon Cheesman, of Te Aroha. electrician, appeared before Mr. F. W. Platts, S.M., charged with negligently driving a motor vehicle on April 14 last, and also with negligently driving a motor vehicle, thereby causing the death of Ellis Vernon Walker, both chargc-3 arising from the same circumstances.
Evidence was given that on April 14 accused and Walker had driven from Te Aroha to Morrinsville in a demonstration motor-truck. Early in the evening they left for Te Aroha, the truck being driven bj- accused. After travelling some three miles the truck left the road and, after turning completely round, fell over on to its left side.
Joyce Jackson, a domestic, gave evidence that she saw the truck turn over, and saw the accused get out of the right-hand side of the truck. The injured man wa3 lying some 12ft. away from the truck, having been thrown out.
Dr. G. Craig gave evidence of tho fatal injuries received by Walker, and stated that; when he arrived accused was drunk and" troublesome.
Mrs. Caroline Walker, widow of deceased, stated that accused reported the accident to her the tame night, and Eaid that he was doing from 35 to 40 miles an hour when he turned the corner. He did not know what happened, but the wheels seemed to crumble and the truck turned over. Accused was committed to the Supreme Court at Hamilton for trial on the indictable charge. The summary charge was adjourned until September 7. Accused was admitted to bail in his own recognisance of £IOO and one surety of £IOO.
