TO PAY [bt telegraph—OWN cobbespondent] TE PUKE, Friday A sequel to a collision between two cans on the Ohinepanea overhead bridge last July was a claim heard in the Magistrate's Court "at Te Puke yesterday. A nativd, Takuira Mita„, sued the Tauranga County Council for £25 .special and £2O general damages. The council counter-claimed for £9 15s 7d. Mr!: >F. W. Platts,' S.M., was on the Bench. Mr. L. Manning (Te Puke) appeared for plaintiff, and-Mr. J. Auld 1 (Tauranga) for the defendant council. -It was stated that plaintiff was driving a car from Ohinepanea and was crossing the bridge when the defendant council's car, driven by the county engineer, approached from the opposite direction. The parties were unable to stop and the vehicles collided. Ihe magistrate held that the county engineer had approached the bridge at a speed which did not give him time to stop to allow plaintiff to cross. Plaintiff, on. account of his being well on the one-car bridge, had the right of way. Judgment was given for plaintiff on the claim for £25 special and £l£ general damages, and costs. Judgmeijt was also entered for plaintiff on - the counter-claim.
