DISPUTE OVER ACCOUNTS REGISTRAR'S FINDING VARIED By order of Mr. Justice Herdman at the end of last November the registrar of the Supreme Court was appointed receiver of the racehorse Croupier and was directed to take accounts between the contending parties, J- J. Corry, of Blenheim, and John and James Paterson, of Auckland. In the' Supreme Court yesterday, on behalf of the plaintiff Corry, Mr. Northcroft and Mr. Thomson moved for an order of the Court reviewing and varying tho award by the registrar on tho ground that his finding was against the weight of evidence. The application was opposed by Mr. Inder on behalf of the defendants, Paterson. The registrar had allowed Corry £3 10s a week for a period of 81 weeks for training fees, but Corry claimed £5 10s a week, making a total of £445 10s. Corry also objected to the' registrar's refusal to allow his claim of £lO5 for general expenses of supervision. Mr. Northcroft submitted that the registrar had misconceived his duty. He conceived that lie was to judge what would be a fair thing to pay Corry, whtfreas it was his duty to find out what the hone had actually cost Corry. Counsel submitted that train:tig had cost considerably more, than the £3 10s a week wlucu the registrar allowed. His Honor decided to vary the regis-, trar's finding by increasing the training allowance' by 10s to £4 a week, but' ha disallowed the plaintiff's claim for and in other respects upheld the registrar's finding. On the motion to review he allowed £3 3s costs and disbursements to the plaintiff. In accordance with the registrar's, award judgment was enteie for the defendants Paterson for £325 i i , 3d, the balance due on the accounts. In® question of costs on the general motion ,-, was reserved.
