FAILURE OF APPEAL.
NOTORIOUS GANGSTER. CAPONE TO SERVE SENTENCE. (Received February 28, 5.3 p.m.) CHICAGO, Feb. 27. The Chicago Circuit Court of Appeal has rejected Alpbonse Capone's petition to set aside the verdict of the jury on October 17. Tlie gangster must now serve the 11 years' sentence passed upon him. It is not considered likely that tlie Supreme Court, if Capone carries the case there, will grant him relief.
Alphonse Capone, Chicago's notorious gangster, was convicted by a jury in the Federal Court at Chicago on October 17, after more than eight hours' deliberation, on five out of 23 counts which charged him with evading payment of income tax. The maximum penalty was imprisonment For 17 years and a line of £IO,OOO. On October 24 Capone was sentenced to imprisonment for 11 years and fined £IO,OOO. Jfn addition, ho was ordered to pay the costs of the prosecution. Counsel for the defence announced that an appeal would be lodged. Meanwhile Capone was sent to prison. Apart from his sentence and fine Capone will have to pay £20,000 and £27,470 owing for back income tax.
