NATIVE AGENT ACQUITTED. 'i • [from our own correspondent.] HAMILTON, "Wednesday. Two charges of receiving cheques for £5 each and fraudulently omitting to pay them to Ani Tutuhanga, were denied by Gabriel Elliott, native agent, of Te Kuiti, in a, case involving a native land deal, heard before Mr. Justice Smith and a jury in the Supreme Court at Hamilton to-day. German Martin Davenport, farmer, of Tf> Kuiti, said he gave accused several cheques to hand to native owners and the receipts were to be taken to the bank manager. No receipts had ever been received in respect of the two cheques made payable to Ani Tutuhanga. 'Counsel for the defence said it was reasonable, to suppose that Elliott marie i mistakes in regard to the identity of the particular native to whom he handed the cheques. Had there been intent to defraud, he could easily have executed the receipts. The jury returned a verdict of not guilty.
