DIRECTIONS IN WILL.
FATHER AND CHILDREN. NOT TO WED CATHOLIC. An interesting decision by Mr. Justice Long Innes. in the Equity Court in Sydney, affirmed the principle that a condition in a will debarring a gift if the intended recipient married a Roman Catholic, was good in law. Mr. Bruce Saywell in his will directed the trustees of his estate that lfj either his son or daughter married a member of the Roman Catholic faith they should be debarred from participating in his estate of £121,000. In the event of one marrying a Roman Catholic, his or her share should go to the other. Counsel for the son and daughter argned that the will was a direction to the,trustees to pay over his clients' share,, and that such direction could not be defeated by a proviso as to subsequent happening. .; Mr. Justice Long Innes ruled that the condition in regard to marriage was a valid one, and that the bequest to the son and daughter did not stand in the event of such marriage.
