INJURY TO KNEE JOINT.

COURT AWARDS £325 DAMAGES

The e\(nnt of the injury suffered by a timlcr worker from an accident which happened «n December 17, 1930, was the subject of evidence and argument in a claim hoard by Mr. Justice llerdman in the Supoejne Court yesterday. Plaintiff was Henry Anderson, of Ellerslie, aged 26 (Mr. Sullivan), and he made claim against his employer, the Kauri Timber Company (Mr. llore), for £l3l special damages and £750 general damages. The special damages included £37 for loss of wages and £4O for hospital and medical expenses. The company paid £Bl by way of compensation for loss oi wages up to May, but disputed further liability. The accident happened when Anderson was handling timber in a yard in Fanshawe Street. It was admitted that Ins ryght leg went through a hole in the boards on which he was standing and that a heavy piece of timber fell on his left krve. lie claimed that ho.was still suffering from injury to his left leg, back and hip. He was for a month in hospital and for five months attended as an out-patient. Plaintiff said that after he was discharged from the hospital last May he suffered' pain in his knee and leg and was still suffering. His doctors advised him to have an operation. Dr. W. CI McCaw said he found plaintiff's left tltigh wasted to the extent of half an inch. The man had extraordinarily well-developed muscles. He was not able to straighten his knee. Witness considered the man hat! an internal derangement of the knee joint, lie had become much worse in last month. After an operation the roan should be perfectly well in six months. He was becoming very neurasthenic. Dr.' E. H. B. llilsom said he. agreed that Anderson had something fouling his knee joint, and that an operation would put it right, This evidence was confirmed by that of Dr. K. MacCorniick, and Dr. W. G. Cavew. . Mr. Hove said liability was not disputed, and it was for the Court to assess the damages. His Honor granted plaintiff £325, made up of hospital and medical expenses and loss of wages up to a point six months hence and of £53 general damages Costs and witnesses' expenses were allowed plaintiff. ______
