DAMAGES CLAIM FAILS.
ALLEGED USE OF WHIP.
CASE BROUGHT BY WOMAN.
A claim for £3O damages for alleged assault was brought by Lily Wright (Mr. Cocker) against Francis R. Matthews (Mr. Allan Moody), in tho Magistrate's Court yesterday.
Plaintiff, a married woman, stated that the defendant called at her house on Waiheke Island on July 16 and demanded money for ploughing work that ho claimed to have done. Ho stood on the steps of the house and struck her with a stockwhip, leaving a severe mark on her face. She tried to get tho whip away from him, but it slipped through her fingers before she could grip it. She then went to a neighbouring place for assistance. For the defence it was asserted that when plaintiff snatched at the man s whip the thong accidentally flew up and hit her. After hearing considerable evidence the magistrate, Mr. E. C. Cutten, .said that he had no hesitation in giving judgment for the defendant. It was quito evident that had plaintiff been struck she would have been afraid, but this was not the case, as she followed defendant and tried to get tho whip. Plaintiff evidently got excited and was unable, to givo a very good account of what to'ok place.
