PRISON FOR ASSAULT.

MAN JUST OUT OF GAOL.

SENTENCE OF ONE MONTH.

"This man is.no sooner out of gaol than he assaults somebody." said Mr. F. K. Hunt, S.M., in the Police Court yesterday, when Patrick Byrne, aged 56, fireman, was charged with assaulting Arthur llayward Dowsing in Queen Street on Monday. Mr. Noble, who represented accused, entered a plea of not guilty. Constable Fowke said he was on duty in Queen Street at about 6.20 on Monday evening, and saw accused approach Dowsing, who was selling newspapers. Accused appeared about to hit Dowsing with a placard, but then pushed or hit Dowsing, who fell over the box on which ho had been sitting and fell heavily, injuring his back. The attack was entirely unprovoked. Accused was arrested after a struggle. Mr. Noble: Accused does not seem to have done much.

The Magistrate: Not much! He merely pushed a man down, so that he was injured. The Sub-Inspector: He is just out after serving a sentence for the same class of offence. " Ye.s. I know ; he will keep on assaulting people." tJic magistrate said, in sentencing accused to one month's imprisonment.
