APPLICATION FOR REPEAL.

An application to have the period of cancellation of his driving lic?enro reduced was made by Henry Gage, a farmer, of Papatoetoe, in the Onchunga Police Court yesterday, before Mr F. 11. Levien, S.M,
Mr. Ford, who represented the applicant, said his driving liccnco had been cancelled for 12 months during October, 1929, when Gage bad been convicted of being intoxicated while in charge of a raotor-venicle Applicant was a married man, without a family, and his wife could not drive the car. The grounds for the application were that Gago could not conveniently cany on his calling without the use of Ins car, as he lived soriio distance from other means of transport, and it was also pointed out that more than half the period for which tho cancellation had been made had expired. Mr. Ford said that, if necessary, ho would call witnesses to prove that Gago had reformed since his licence had been cancelled and was now a fit and proper person to drive a motor-car. Sergeant O'Neill, who opposed the application, said that while ho would not deny that Gage had reformed, the police were objecting, as the Motor Vehicles Act, 1924. did not give a magistrate any power to cancel disqualifications of licence-holders. The magistrate said he was afrftid nothing could bo done at tho moment. It was really a matter in which tho Minister of Justice, the Hon. J. G. Cobbe, should be approached. Mr. Ford said in spite of the Act cancellation? had been repealed by other magistrates.
