MOTOR-LORRY DAMAGED.
STRUCK BY FALLING TREE.
SETTLEMENT OF LITIGATION

A claim for £63 for damage to a motorlorry caused by a tree falling across it on the Waitoa-Morrinsville Road' was made by the New Zealand Express Company, Limited, against H. 0. Cooper, farmer, and R. Phillips, sawmiller, in tho Magistrate's Court to-day. Mr. W. J. King, for the plaintiff, stated that the lorry was being driven along tho road in stormy weather, when a falling tree severely damaged the bonnet. On closer examination it was found that the tree had been half sawn through before it fell. This in law constituted negligence on the part of Phillips, the occupier of the plantation, and Cooper, the owner of the property. An adjournment to enable the pnrtirj; to settle the matter was granted, and it was subsequently announced that a payment of £55 by tho defendants to tho plaintiff company had been accepted in full settlement of the claim.
