DISPUTE OVER WIRELESS.

INSTALLATION OF BATTERIES.

A dispute over tho sale and connection of electric batteries for a wireless set resulted in a claim by P. J. Cooper and Sons against Mrs. M. Matthews, of Morrinsville, for £2 ss, heard in tho Morrinsville Magistrate's Court.

Cooper said that in April, 1928, he supplied two batteries, costing £1 each, to defendant. He delivered and installed them at defendant's residence. A charge of 5s was made for installing them. The batteries were returned in June. One was found to be discharged and tho other more than half discharged. The batteries were not paid for and the claim was for their value and the installing cost.

Defendant said slio had instructed Cooper to instal a wireless set. She ordered,,,the batteries and told plaintiff to connect them and see that all was in order. Cooper had done this, saying that if tho set was not working to let him know. The set had not worked and she had returned tho unused batteries.

Mr. Wyvern Wilson, S.M., in non-suit-ing plaintiff, said tho two stories were equally strong. Plaintiff had apparently not dono tho work and was, therefore, not entitled to bo paid until ho did it. The batteries could not have been used as the set was pot working.
