H. Levien. S.M., in tho Onehunga Police Court yesterday. Mr. Rogers appeared for Iho shopkeepers and Mr. Tong for Mr. Hutson, Evidenco in support of the application was given by 11. C. Rowlands, grocer, 'J'. C. Turn bull, chemist, and John Wynn, tobacconist, who stated that Hutson's ex-, eruption affected their businesses. They also said that since the exemption order, had been granted to him, Hutson had added several fresh lines to his stock. In granting tho application the magi*-. Irate said Ilutson had not acted in good faith when he added such items as toilet requisites and patent medicines to his stock. It would bo inequitable to allow him to carry on under cover of his exemption, as no trader should have such undue preference. The magistrate added that tho statute was very indefinite, and if other Onehunga shopkeepers found that their returns were being affected by exemptions tho wholo question would have to be reopened.
