ALLEGED ARSON SCHEME.

DISCHARGE OF ACCUSED

COMMENT BY MAGISTRATE

[BY TELECJItAPII. —OWN COURESPONPENT.] NEW PLYMOUTH, Wednesday.

Reserved judgment in the case in which Henry Rielly was charged with inciting three" young men to commit arson by allegedly offering them money to set firo to his shop, was given by Mr. 11. W. Tate, S.M., to-day. The magistrate said he did not think it proper, on the evidence before him, to enter a conviction. The case, however, was a proper ono for the police to havo brought. The community should know that any person who incited another to commit an offence which was punishable by imprisonment was also punishable on conviction. He suggested that Rielly was not as intelligent a person as the other young men concerned in the case, and he should be careful in his associations.

'I lie magistrate added that lie did riot believe the evidence of the young men concerned. He did not believe that ho had heard the whole truth of the occurrence. Rielly was entitled to the benefit of tho doubt and the informations would 1,0 dismissed. It seemed to him that it was more easy for a person of Kielly's calibre to collect from an insurance company than lie would have supposed.
