BAILIFF CHARGED.

SERVING A SUMMONS.

FALSE STATEMENT ALLEGED.

ACCUSED SENT FOR TRIAL.

Charged with making a false statement with regard to the serving of a summons, Julius Barth, a private bailiff (Mr. Schramm), appeared before Mr. F. K. Hunt, S.M., in the Police Court yesterday. It was alleged accused swore on oath that he had delivered a summons to William Greon personally, and that this st<f tement was untrue.

Rose Elizabeth Banber said she lived with her son-in-law, William Green, in Dominion Road, last year. In November Barth asked her whether William Green was in the house, and was told he was in hospital. He left a summons issued against Green with her.

William Green said he had not received any summons from Barth.

A clerk gave evidence as to filling in an affidavit of service of the summons and accused signing it. Evidence as to the swearing of the service before him was given by the assistant clerk of the Magistrate's Court. In a statement, accused said he had given the summons to Mrs. Banber to deliver to Green, as she informed him he could not see Green at the hospital. In the affidavit he swore on oath that ho had delivered it personally. He had been employed in this class of work for several years.

Pleading not guilty, accused was committed to the Supreme Court for trial. Bail was fixed at £SO.
