SYDNEY, March 30. Tho Full Court allowed tho appeal by Babcock and Wilcox, Limited, against tho magistrate's decision convicting and |- u ,i ni r the linn £IOOO in connection with the fit y Council graft charges, and ordering' a refund of £IO,OOO to the City Council for an alleged offcnco under the Secret Commission's Prohibition Act. Hv a majority tho Court held that while there might bo suspicion, that could never.be accepted as a ground for conviction, which should rest only upon ;m established fact.
