FLOODING OF SECTIONS.
COMPENSATION CLAIMS. TWO CASES FFIOM TAKAPUNA. Two claims for compensation against the Takapuna Borough Council wove heard by Mr, Justice Smith in the Supreme Court, yesterday. It was agreed to take both the cases, which were of similar nature, together.' The claimants, for* whom Mr. J. B Johnston appeared, were Edward MeLeod and Curtis Robert Armiger, and they claimed they had been subject to loss and their properties depreciated as a result of drainage works carried out by the council (Mr. Lowrie). Mr. MeLeod claimed a total of £3ll 10s in respect of two sections in King Edward A>»iuc and three in Opua Street, which it was alleged had been depreciated in value chiefly through a flow of water from a borough drain. On similar grounds Mr. Armiger claimed £SO for one section in King Edward Avenue. Mr. Justice Smith had associated with him Mr. A. Greville Walker, as assessor for the Takapuna Borough and Mr. T. F Ilarina as assessor for claimants. The parties concerned spent, most of the morning in viewing the sections at Takapuna. Afterwards evidence was given by the claimants, bv a number ot residents and by several experts, who stated the flow of water on to the sections had been substantially increased, and their value depreciated since the council's drain was put in last year. The claimants' case was closed, and the case for the Takapuna Council will l>e heard to day.
