COLLISION AT MANGERE.
CAR AND MOTOR-CYCLE. CLAIM FOR £1079 DAMAGES. A collision between a motor-cycle and motor-car, which occurred at tha corner of Coronation Road and Mclntyre Hoad, Mangere, on July 30 last, formed the subject of a substantial claim for damages in the Supreme Court yesterday before Mr. Justice Blair and a jury of 12. Tha plaintiff was Charles Baker, labourer, Onehunga (Mr. Finlay), and the defendant Thomas Gardiner Ex ton, salesman, Papatoetoe (Mr, Leary). Plaintiff, who was riding a motor-cycls at the time of the accident, claimed damages amounting to £1079 for loss and injuries, alleging that defendant had been guilty of negligence in coming across the line of traffic in Coronation Road at an excessive speed," in cutting the corner and in failing to give warning. The defence was that defendant had exercised due care in watching the road, but that plaintiff was travelling at an excessive speed and came upon him so suddenly that an accident was unavoidable. The jury was taken out to view the spot before evidence was heard. The hearing of witnesses for plaintiff continued until late in the afternoon and after Mr. Leary had opened for the defence the Court adjourned until this morning.
