CASE ENDS ABRUPTLY.
PERJURY PROSECUTION.
WITNESS DIES IN HOSPITAL.
ECHO OF MOTOR COLLISION. A charge of perjury against Ernest Gilbert, blacksmith, collapsed; in the Police Court yesterday when it was announced that the witness whose absence resulted in the adjournment at the previous hearing 011 February 23, died in the Auckland Hospital last Monday, The case arose out of the acquittal of Gilbert in February, 192Q, on a charge of negligently driving a motor car at Onehuuga. A collision occurred with a cyclist 011 Mangere Bridge and when prosecuted Gilbert declared that he and another man were the only occupants of the car. The police had since alleged that there were two women, and at the opening of the case a fortnight ago. a woman stated she was a passenger.
The case was adjourned by Mr. F. K. Hunt, S.M., when it was said the other woman concerned was in the hospital. At the resumption yesterday the police intimated the witness died on Monday.
Mr. Goldstine, counsel for accused, asked for a dismissal 011 the ground that a prima facie case had not been made out. Tho magistrate concurred.
