REHEARING OF A CHARGE.

MAGISTRATE REDUCES FINE

A short list of offences by motorists was dealt with in the Police Court yesterday. A rehearing of a charge against David Lye (Mr. Brewer) of using a lorry without a heavy traffic licence was granted by Mr. W. R- McKean, S.M.

Mr. Brewe i said defendant did not appear lo answer the charge, and was fined the maximum penalty of £2O. He had, however, sincft the charge was laid, taken out a licence for the full year. Mr. Terry, on behalf of the Mount Eden Borough Council, said defendant had paid £4U lor his licence, but when a traffic inspector placed his loaded lorry on. a weighbridge he found it required to pay a licence fee of £55. The magistrate said that in imposing the maximum penalty he had taken into consideration the fact that there was no provision toi recovering the licence fee for the months, during which the vehicle was unlicensed As a licence had been taken' out for the whole year he would reduce the fine to £5. Had defendant paid the full fee of £55 he would have reduced the fine still further.

A similar charge in respect of another lorry was brought against defendant by the Auckland City Council, and' a fine of £2 was imposed. On charges of dangerous or negligent driving, A. li. Griffiths and W. G. Mills were fined £2 each, and W. Knox £l, while A. Robertson was ordered to pay costs. £2 Is. For speeding, E. C. Carlquist and R. Colebrook were fined £2 each, and H. T. Whitson £l. For breaches of parking regulations L. G. Briggs was fined £l, and A. G.' Mason, B. R. Share, C, A. Woodward and H. C. Smith 10s each.

On charges of having insufficient lights, R. Linkhorn was fined £2, and T. Crab, R. Nightingale and R. Parkinson, 10s each, while P Mason, C. Scott and C. G. White were each ordered to pay costs, 16s. Fines of £1 each were imposed on H. Beth oil for failing to notify change of ownership, on S. Miller for pillion riding, and on F R. Smith for not having an endorsed certificate. For passing a stationary tramcar, W Phillips was fined CZ. On a charge of not having a driver's licence B Bree was ordered to pav costs, 15s.
