NEGLIGENT DRIVING.

HEAVY FINE IMPOSED. COMMENT BY MAGISTRATE.. [BY TELEGRAPH. —OWN CORRESPONDENT.] 1 NEW PLYMOUTH, Saturday. A fine of £2O, with costs £5 2s, was imposed in the Magistrate's Court upon O. Thomas, who was convicted of driving negligently at Eltham. The proceedings arose out of a sensational accident in which Thomas' car, after passing another car, turned a somersault in the other vehicle's path. The car had a full load of passengers, but no one was seriously hurt. At the hearing of the case the magistrate, Mr. R. W. Tate, deferred the question of penalty, but intimated that he considered the driver's licence should be suspended. Counsel explained that, defendant had a wife and two children to keep and his livelihood depended upon his holding a driving licence. The magistrate, in giving his decision, said it was a bad case and the only cure was to put offenders off the roads. However, he did not want to take away the man's means of livelihood, but a heavy penalty had to be imposed. Application for time to pay was refused.
