" It seems to me that neither under sections 164 or 327 of the Municipal Corporationii Act, nor under section 119 of the Public Works Act, nor by the. conjoint effect of ail of them has the council any legal authority to create a nuisanc* by the creation of the proposed bridge. The injunction, therefore, is granted with costs, which I fix at £35, and disbursemeats," said Mr. Justice Stringer in a reserved judgment :n the Supreme Court to-dav in the case concerning the proposal to build a badge, over the Avon at New Brighton The judgment will prevent the New Brighton Borough Council from building thebridge unless the decxaou is appealed against successfully. The case was brought by a ratepayer, who sought an injunction restraining tbs New Brighton Borough .Counc:lfrOT» erecting the propose! 'bridge over th® Avon on the ground that it would impede navigation.
