PRIVY COUNCIL APPEAL.

NOVA SCOTIAN PARLIAMENT. UPPER HOUSE ABOLITION .CASE. "A., and N.Z. . HALIFAX. Nov. 16. The Supremo Court of Nova Scotia at Halifax to-day granted special leave to tho Provincial Government to appeal to the Judicial Committee of tho Prfvy Council in the matter, of the proposed abolition of the Legislative Council. A message from Halifax, Nova Scotia, on October 23, said the Supreme Court was equally divided in a case which bad been submitted for its decision. This was whether or "not the membership of the Legislative Council could be increased at the instance of the Government of Nova Scotia, 'or whether the members of the council held their appointments at the pleasure of the Provincial Government. The, matter was. to be taken either to the Supreme Court of Canada or to the Judicial Committee of the Privy Council. The case arose ont of the desire of-the Government to abolish the Upper House. I! the Government's position is sustained the council will either be abolished by appointing a sufficient number of new councillors pledged to support an Abolition Bill or by the members who oppose the change being retired. In the event of the Government's position being finally disapproved a plebiscite will be held. .
