SEQUEL TO A FIGHT.
FALL OF SHIP'S STEWARD. THE COMPANY NOT LIABLE. The case in which Percy Clarence Earl (Mr. Holmden), a steward on the steamer Rarawa, brought a claim against the Northern Steamship Company (Mr. Meredith), following an injury he sustained through a fall on the steamer after a fight, was concluded in the Arbitration Court yesterday. Mr. Holmden submitted that the fight had been trivial and had not affected plaintiff sufficiently to have caused him to tall on the ship's ladder. Mr. Meredith said plaintiff was not entitled to leave duty to go below to his quarters. In the second place he had been in a dazed condition as the result of the fight. Mr. Justice Frazer said plaintiff was undoubtedly sober. He had, however, made an unjustifiable attack on another steward and "had probably got more than he was looking for. He had explained that he had been going below to change his boots, but since he had been on duty a short time, this did not seem a reasonable explanation. It may have been that plaintiff was suffering from delayed shock, and was seeking his bunk. Judgment was for the defendant company.
