WOMAN ON A TRAIN. VERDICT FOR £249 DAMAGES. Miss Eva Grenville, saleswoman, of Hawksburn, Victoria, has obtained damages against the Railways Department following injuries received through 1 falling from ; a railway carriage to the permanent way when a sliding door slipped open. The action was .concluded before Judge Williams and a jury of four in the County Court recently. * Plaintiff pleaded that she was a passenger by the train from Hawksburn to Flinders Street on November 10, aifrl that the department had not carried her "safely and securely" in accordance with its contract. Alternatively she claimed damages for breach of contract on the part of the commissioners in having failed to carry her " safely and securely." Plaintiff, in evidence, said;—On November .10 1 was a passenger by an evening train from Hawksburn to Flinders Street. When passing the curve near the South Yarra station the train jolted. This caused me to press back against the door, and the door gave way. I fell on to the permanent way and was injured. I was treated in the Melbourne Hospital for my injuries. Counsel for the defence said that evidence would be given that the train did not jolt, as indicated by Miss Grenville and her witnesses. A number of witnesses were called on behalf of the Railways Department^ The jury returned a verdict for £249, the full amount claimed. Judgment was entered accordingly, with costs.
