CLAIM FOR COMMISION.
RULING OF THE MAGISTRATE. A dispute between a motor salesman. G. S- Gordon (Mr. C. A. Sneddon), and the proprietor of a motor garage, E. Eadv (Mr. Haig), was the subject of a' reserved decision given by Mr. E. C. Cuttcn, S.M., in the Magistrate's Court yesterday. Gordon claimed £o3 13s 9d for commission he alleged to be due to him while in the employ of defendant. There were four claims altogether and to all of them defendant put forward the defence that in no case did the plaintiff obtain the signature of the purchaser to an order. Regarding . this point the magistrate said that in the absence of a special rule which a- firm may impose upon its salesmen to settle any question of conflicting claims, this was not a necessary factor to prove a claim so. long as the salesman was the effective cause of the sale taking place. Judgment was entered for plaintiff for £62 19s 3d.
