APPEAL DISMISSED
HAND VERSUS PATTERSON. QUESTION OF CREDIBILITY. [BY TELEGRAPH.—PRESS ASSOCIATION.] WELLINGTON. Wednesday. In the . Hamilton appeal case Hand v. Patterson, Mr, Justice Sim, in delivering the judgment of the Court, said the appeal should bo dismissed. Mr. Justice Herdmati had accepted Ihe evidence of Vi-.ttorson that Hand had mi&roprc-seiuf.-'i the position. It was a question of .Thorn to believe, and the Judge could hotter see the demeanour and appraise the veracity °or otherwise of the witnesses. If the learned Judge was satisfied Patterson was speaking the truth then the Court had nothing to disturb. Mr. Justice MacGregor and Mr. Justice Alpers concurred. Costs on the highest scale were allowed respondent.
