Detective O'Sullivan produced a statement in which accused admitted receiving money from cash customers and "failing to hand it over. He attributed his lapse-to the illness of his family. "Jfcs" 1 cused found- himself in -financial difficulties and considered he was entitled to reimburse himself out of the money he collected from cash customers. It was • a question of setting one account _ against another and with, the ,£B deducted 'Cosnoii owed accused £l7. He had placed this position before Mr. Hogben, who was acting for Connon. Mr. Hogben said Connon took no'part in the prosecution. He had not;been in urgent need of the loan of £SO from accused, but had put the money into the business,, as he had found accused a good workman. The magistrate, Mr. Poynton, said the illness in accused's family was an extenuating circumstance. He" would be admitted to probation for 12 months and would have to make restitution. In granting the order for suppression of the name the magistrate remarked that • accused could hardly be regarded as a first offender, since he had been misappropriating small sums for a considerable period beiore he was detected.
