A DISPUTED CONTRACT.
SUIT FOR RECISSION. PLAINTIFF'S CASE UPHELD. Decision was given by Mr. Justice Stringor in the Supremo Court yesterday in a case in which Charles Henry McGutchan (Mr. Golding) sought rescission of a contract made with George William Smith (Mr. Leary), and the recovery of certain money expended under the agreement. The contract concerned an agreement for purchase by plaintiff of certain laud owned by defendant. • His Honor said he came to the conclusion that the construction of the agreement as contended by the plaintiff _ was correct. He thought that defendants, refusal to carrv out the contract according to what His Honor held was its true con struction amounted to a repudiation of the contract, which gave plaintiff the opportunity of rescinding the contract ot which he availed himself. Judgment was given for plaintiff.
