CRUSHED BETWEEN TRUCKS.

SEQUEL TO NEW LYNN ACCIDENT.

Injuries sustained by a 12-year-old girl through being crushed by railway trucks in Matai Road, New Lynn, formed the basis of a claim for £100 general damages, and £18 15s 6d special damages, brought by her father, Alfred Stafford (Mr. Devine), against the New Zealand Brick and Tile and Pottery Company, Ltd. (Mr. Bennett), at the Magistrate's Court yesterday, before Mr. F. K. Hunt, S.M. Maudie Stafford stated in evidence that she was crossing the road and was about to pass through a gap between two lines of trucks, when they were moved and her left hip was fractured. Dr. Grant, of the Auckland Hospital, gave details of the injuries received by the girl, and expressed the opinion that a slight deforhiity would bo permanent, but would not affect her activities or cause | suffering. Corroborative evidence was given by Dr. Brokenshire. v Witnesses to the accident said that the child was reasonably alert. For the defence it was stated that the three men in charge of the trucks kept a keen look out.

Mr. Hunt held that there had been negligence on the part of the company's employees. Judgment was given for plaintiff for the amount claimed.
