SALE OF A PROPERTY.
PLAINTIFF'S CLAIM SUCCEEDS.
A claim for £38 15s commission 011 tho sale of a dwelling was brought by Cyril McDonald, land agent (Mr. Fitzherbert), against Mrs. Joan Mellor (Mr. Schramm), at tho Magistrate's Court yesterday beforo Mr. E. C. Cutten, S.M.
Wilfred P. Atkin, land salesman, stated that defendant had agreed to accept £1350, for the property. The sale had been effected on this understanding. Tho defence was that verbal instructions had heen given for alteration in tho terms of the authority to sell, and that, the price was to be '£1400. II was denied that plaintiff was entitled to commission at the price received. After commenting 011 inconsistencies in the evidence called bv defendant, the magistrate gave judgment for plaintiff for the amount claimed.
