APPEAL IN SALAMAN CASE.

LEGAL OBJECTION RAISED.

The sentence of one month's imprisonment imposed on Tuesday by Mr. J. • Poynton, S.M., on the "Indiaai Herb Atah," ' Abraham Wally Mchamed Salaman, for attempted false pretences, was the subject of an appeal made by Mr. Finlay yesterday. Ho has been breaking the law hundreds of times. Once sentence is imposed, the case is at an end, and it would bo irregular to alter my decision now. Mr. Finlay: You are assuming that ho is a swindler. v Mr. Poynton: He is not a doctor, and has been imposing on the public and selling dangerous drugs. If I reconsidered the sentence I would run the risk of having myself brought up before the Supremo Court on a writ of prohibition by this very man. Mr. Finlay: There would be no chance of that. Counsel then intimated he would exorcise his right of appoal on question of law. Tho magistrate thereupon fixed security :tor appeal at £15 15s, in addition to the bond entered into by accused for the suspension of tb a warrant for committal to prison. The sentence is accordingly suspended pending Supreme Court action.
