WIFE'S MAINTENANCE.
APPLICATION FOR INCREASE.
REFUSAL BY MAGISTRATE.
Domestic strife between James Williamson and his wife, Mary Williamson, has frequently caused them to resort to tho Magistrate's Court for a ruling upon the issues in dispute. Yesterday Mrs. Williamson initiated proceedings before Mr. E. C. Cutten, S.M., against her husband for an increase of her existinomaintenance order of 35s a week.
Mr. Biernackj appeared for applicant and Mr. Allan Moody opposed the action on behalf of defendant.
Mr. Moody said that when tho standing order was made, the magistrate had expressed the hope that finality was reached. There was no change in the circumstances of Mrs. Williamson, and no reason why tho adequacy of the magistrate's previous order should be questioned.
Mr. Biernacki said thafi defendant would not pay regularly, and suggested that £3 a week was a reasonable allowance. His client had found it impossible to live on 35s a week.
The applicant said that since the current order was made she had sold her apartment house, and was now paying £2 2s for board. She had been told that her husband earned £35 a month.
Mr. Cutten said that ho was not aware that any new facts had been elicited in support of the appeal. The case was dismissed.
