INJUNCTION GRANTED.
GISBORNE HARBOUR PLANS. [BY TELEGBAJH.— association.] GISBOENE. Tuesday. In the Supreme Court to-day, Mr. Justice Reed delivered his decision in the case of- G. H. Lysnar v. the Gisborne Harbour Board. Plaintiff sought an injunction restraining the board from circulating or making use*"of a plan prepared by Mr. Leslie Reynolds, ■which, plaintiff complained, was a copy of his plan, and an infringement of his copyright. The similarities, His Honor held, had not been deliberately copied by Mr. Reynolds, and where there were differences, there were good engineering reasons for them. His Honor, however, gave judgment for plaintiff (Mr. Lysnar), holding that it was the duty of the, board, in view Aof the ; fact that it was unable to comply with, the terms upon , which the scheme, or idea, had been communicated to it, to return the property for which it was unable to pay. He held that the board had made us© oT the idea inasmuch as it had published the. idea through the medium of Mr. Reynolds' plain.
