MORTGAGE LAWSUIT.
•UNDEFENDED ACTION. j A claim under a mortgage deed over' property was heard before Mr. Justice I Herdman in the Supreme Court yester-1 | day. The plaintiffs were the Guardian : I Trust and Executors Company of New j I Zealand, Ltd. (Mr. Hogben), as trustees lof the estate- of James McGinley, de- • ceased, and the defendant was James Rohan Phillips, of Opotiki, the mortgagor. The amount of the mortgage was £4250, while interest, rates, etc., amounted to £319 16s, and plaintiffs claimed for these 'amounts. The statement of claim indicated that the mortgagor had disposed of tho property on which tho mortgage was issued by sale in January, 1921. The ac- j tion was undefended. Mr A H. Pellow, from the office of the plaintiffs, stated that the defendant i had made considerable default in regard to the pavment of interest. He had also failed to "pay the rates, and these had been paid by the plaintiffs.. f The jury returned a formal verdict for the plaintiffs for the full amount claimed, £4569 16s, with costs.
