An action to decide the ownership of the well-known trotting stallion, Our Thorpe, cam* before Mr. Justice Stringer in the Supreme Court to-day, when Amos Currant (Mr. Northcroft), farmer, Koromatua, sued Augustus, Cameron (Mr. Hogben) for possession of the horse.Mr. Northcroft said the horse was grazing, on plaintiff's property, and plaintiff purchused it from -one Young for on the understanding that at alater date Young could repurchase at £300. \oung failed to repurchase and the horse was then registered in plaintiffs name, bubscquontly plaintiff found the horse missing from his property. Ho got into touch with the police and suggested Young bad taken it. He found that Young had not taken it, but that Cameron had removed it and informed the police of what he had done. , Plaintiff gave evidence in support »1 Mr. Northcroft'fl opening. Mr. Hogben said Camoron took the horse because Young had taken it from him, and lie believed that, plaintiff was merely a "tool of Young's." There was some feeling between Young and Cameron, and to revenge himself Young took the horse and secreted it. Young had admitted that Cameron was a part owner of the horse. The Judge said admittedly Cameron was only part owner, and if Mr. Northcroft was satisfied Durrant wag part owner it would be better to sell and divide the proceeds. Ho suggested counsel should confer. After an adjournment counsel said that their clienta had been unablo to agree as both wanted to buy the horse. The Judge said then the best plan would be to let them bid for it. Accordingly he would amend the statement of claim bo as to allege that a partnership agreement existed as between Durrant and Cameron in equal shares, he would dissolve the partnership, and appoint Mr. V. H. Sanson to wind up the partnership and sell the- horse, the costs of both parties to be paid out of tho proceeds.
