POSSESSION OF ROOMS.
APPLICATION REFUSED. —«—. NOT WANTED FOR OWN USE. A claim for possession of two rooms in a four-roomed house in Olive Road, Par--nell, was made in the Magistrate's Court yesterday before Mr. W. R. MeKean, S.M. Rent was also claimed, but Mr. Hackett, 'for defendant, said his client had paid the rent regularly to the plaintiff's wife and he produced the receipt. The position was that the plaintiff had purchased a house at Penrose and could not get possession. He desired that defendant should vacate her rooms in order that the tenant of the Penrose house might live there. He let the rooms to defendant on the understanding that the had two children, but subsequently two more eons who had been boarding came to live with their mother. Plaintiff himself wag married and had so that altogether there „;-were nine people at present in the four-roomed house. The tenant of the Penrose house had five children. Mr. Hackett asked where the woman _was to go to if she was ousted from her present rooms. Mr. Dickson, for plaintiff, said that if and order were made, reasonable notice would be given so that she might get other quarters. Mr. Hackett : But where ? Mr. Dickson said that when orders were made for possession people seemed to find Other houses. It was certainly not healthy that nine people should be living in a four-roomed house, with two sleeping in the kitchen were the food was kept. The magistrate said the position was unfortunate, but the applicant did not waut the rooms for his own use. He did not think he should make an order in the circumstances.
