APPEAL FOR NEW TRIAL.
[Br TELEGRAPH.—PRESB ASSOCIATION.] WELLINGTON, Tuesday.
Trie Court of Appeal was engaged today in.hearing an application for a new trial in the case of Franklin John Smith (known as Pit Pot Smith), who was convicted at Auckland' last year on a pharge of rape. Smith was represented by Mr. Myers and (With him) Mr. Allan Moody, Mr. McGregor, K.C., appeared for the Crown. Tho application was based on the ground that the verdict of the jury was unreasonable and against the weight of evidence. Tho Court- reserved its decision. ■ i '■'■'- "'
