ALLEGED FORCIBLE ENTRY.

PARTIES COMB TO AGREEMENT.

Decision in-the prosecution brought by Hettie Evelyn. McKee (Mr. Sullivan) against Esther Noble and Albert A. Noble (Mr. Mooch*}, for alleged forcible entry of a house in possession of informant, was given by Mr. E. C. Cat ten, S.Mr, in the Police Court yesterday. The alleged offence took place the'day following tfce hearing of an application, by the landlord, Noble, for an order for possession, which had been refused- by the Court. Defendants /had mad© arrangements by ■which they could enter a room, in which their furniture was stored, through the wiriSow. It was alleged they wanted to live there. ' The magistrate said ho had come to the conclusion that a proper case for committal if or trial had been made out. Ha suggested, however, that if the arrangements for entering the room through the window were removed and defendants gave an assurance that they would not attempt to repeat the acts complained i of, the information should be withdrawn. He was sure a jury would not convict if such assurance were given in the Supreme Court. During a discussion on the matter the magistrate said defendants evidently went to the house to obtain by other means what they could not obtain in the Civil' Court. Finally it was agreed that defendants should give the assurance required by the informant, and pay £2 2s costs, and tse information should be withdrawn.
